What Is a Trademark?
A trademark is any sign that distinguishes the goods or services of one undertaking from those of other undertakings. Within the scope of the Industrial Property Law No. 6769 (SMK), trademark registration grants exclusive rights to its owner and prevents unauthorized use by third parties.
Why Is Trademark Registration Important?
Using an unregistered trademark carries a significant risk: the same or a similar trademark may be registered by someone else. Once registered, a trademark is protected for 10 years within the borders of Turkey, and this protection can be renewed indefinitely.
In addition, registration entitles the owner to use the ® (registered trademark) symbol, which enhances brand credibility and consumer trust. Trademark registration also strengthens your legal position in potential disputes and provides a solid basis for enforcement actions.
How Does the Trademark Registration Process Work?
The registration process begins with an application to the Turkish Patent and Trademark Office. The application goes through several stages, including formal examination, examination for absolute grounds for refusal, publication in the official bulletin, and possible opposition by third parties.
If no opposition is filed within the publication period, or if filed oppositions are rejected, a trademark registration certificate is issued. At this point, the trademark becomes legally protected.
